Dispute Mediation Policy

This Policy sets out the dispute process to be followed when Employer & Freelancer who have used the (Milestone Payment system) elect to use to the Milestone Dispute Mediation process to resolve a dispute between them.

The Milestone Dispute Team

Both parties of the Dispute case can elect to have their dispute judged by the Dispute judgment Team. The role of the Dispute judgment Team extends to making all actions necessary to resolve the case in a Fair and evidential manner. You acknowledge that the judgment of the Dispute Team is final, binding, and irreversible.

User Responsiveness

Employers

Once a dispute is opened, an Employer is given 5 days to respond to it. Otherwise, they will automatically lose the dispute and the pending Milestone will be released to the freelancer's account.

Freelancers

Once a dispute is opened, a Freelancer is given 4 days to respond to it. Otherwise, they will automatically lose the dispute and the pending Milestone will be returned back to the employer's account.

Milestone Dispute Mediation Process

  • First Phase - Tell us what is the problem?

    Write full description of the issue and an explanation of why the dispute is being opened. From this stage until Third Phase, users must submit/attach any files that could support their claims.The User will Enter Total amount of Milestone payment or payments to be disputed.

  • Second Phase - Discussion

    At this stage, either party can negotiate for (partial compensation) to solve the dispute without referring it to Dispute judgment Team. Both parties will have the opportunity to tell the story from their side and also negotiate terms to resolve the issue between themselves.

    The complainant can (offer) amount he or she is prepared to pay for the Project (if an Employer) or wish to get paid for the Project (if a Freelancer). The amount could be between zero and the total amount of the Milestone Payment(s) in dispute.

    Only the party who originally filed dispute can cancel the dispute. If the dispute cannot be resolved through negotiation, either party can choose to pay the Judgment Fee to have the dispute solved by the Dispute judgment Team.

  • Third Phase - Last offers / Proofs

    Last chance where both Users can submit their final evidence to support their case. After that both parties are no longer allowed to submit any new evidence. The dispute will be resolved based upon the evidence provided through the Dispute System, project description and chat between the parties. Once the dispute has proceeded to Final Phase, further evidence will no longer be accepted.

    After one of the involved parties has paid the Judgment Fee, the other party has 2 days to also pay the fee. If the other party does not pay the Judgment fee within the 2 days, the result will be in favor of the party who initiated the Dispute judgment Team first (Final Phase), with the Judgment fee initially paid refunded.

  • Final Phase - Judgment

    At this phase, the Dispute Team will review all evidence and other information provided to reach a decision (usually within 48 hours). Dispute judgment are final, binding, and irreversible. The party who wins the dispute will be refunded their Judgment Fee.

Evidences required for your dispute

If you elect to have the Dispute Team arbitrate your dispute, you agree to allow the Dispute Team to read all correspondence (chat) made on the Site and download or access, and test (if necessary), all uploaded files, programs, and websites related to the dispute for the sole purpose of having your dispute resolved.

You are highly encouraged to submit all the documents that would support your claims on your dispute. Provide products, contracts, E-mail, instant messenger screenshots and any other files relating to the project and the dispute.

Lancli.com will retain the confidentiality of the project and the privacy of the involved users and will not release the collected information to any party unless required by law.

Fees

The fee for a milestone Dispute judgment Team is $5.00 USD or 5%, whichever is greater, payable by both parties. The fee will then be refunded to the winner of the dispute. See the Fees and Charges page for details.
